How a Florida tax certificate sale works

Osceola County follows the same statewide process every Florida county uses (Florida Statutes Chapter 197):

  1. Taxes go delinquent

    Real-estate taxes unpaid by April 1 become delinquent. The tax collector advertises the delinquent parcels and prepares them for the annual certificate sale (on or before June 1).

  2. Public / electronic auction

    The county sells a tax certificate against each delinquent parcel at a public auction — almost always online through the county's certificate-sale vendor. Registered bidders compete.

  3. Lowest interest bid wins

    Bidders bid down the interest rate, starting at 18% and dropping in quarter-point steps. The lowest interest-rate bid wins the certificate (a 0% bid is allowed).

  4. Face value is paid to the county

    The winning bidder pays the certificate's face amount — the delinquent taxes plus interest, advertising, and fees. That payment satisfies the county; the investor now holds a lien, not the property.

  5. The certificate earns interest until redemption

    When the property owner redeems (pays off) the certificate, the holder gets the face amount back plus the bid interest (with a 5% minimum return on non-zero-percent bids). Most certificates redeem.

  6. Tax deed after two years

    If the certificate is not redeemed, the holder may apply for a tax deed once two years have passed since April 1 of the certificate year. That forces a public tax-deed auction of the property itself.

A tax certificate holder, or an agent of the holder, may not initiate contact with the property owner to encourage or demand payment until two years after April 1 of the year the certificate was issued. Violations can bar a bidder from the sale and may be treated as unfair or deceptive conduct.
